What You Need to Know for June 2014

The Judicial Conference of the United States approved amendments to the Bankruptcy Court Miscellaneous Fee Schedule, which will go into effect on June 1, 2014.  The amendment affecting most bankruptcy filers is an increase in the administrative fee assessed at the filing of every bankruptcy case.  The administrative fee will increase to $75.00 for Chapter 7 and Chapter 13 bankruptcy filings.

The increased Chapter 7 filing fees consist of a $245 filing fee + $75 administrative fee + $15 trustee surcharge for a total of $335.00.  The complete filing fee of $335.00 is due at the time the case is filed with the court beginning June 1, 2014.  Currently, the Chapter 7 filing fee is $306.00.

The increased Chapter 13 filing fee consists of a $235 filing fee + $75 administrative fee for a total of $310.00 due at the time the case is filed with the court beginning June 1, 2014.  Currently, the filing fee for Chapter 13 is $281.00.

Filing fees for Chapter 7 and Chapter 13 cases last increased in November 2011 from $299 to $306 for Chapter 7 and $274 to $281 for Chapter 13.  As with everything else in our economy, the cost of filing bankruptcy continues to rise over time.
